Important: Fit Trainer does not provide medical or professional fitness advice. Exercise at your own risk and consult a qualified health professional before starting any program.

1. Your Agreement With Fit Trainer
These Terms of Use (“Terms”) govern your access to and use of the Fit Trainer mobile application, website, content, products and services (collectively, the “Services”) provided by an individual operator doing business as “Fit Trainer” (the “Operator,” “Fit Trainer,” “we,” “us” or “our”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
2. Privacy
Your personal information is handled according to the Fit Trainer Privacy Policy, incorporated here by reference. By using the Services, you consent to the collection, use and disclosure of your data as described therein.
3. The Services
Fit Trainer provides algorithm-generated workout plans, exercise demonstrations (images/videos) and related fitness information based on the details you supply (fitness level, goals, schedule, equipment, etc.).

No Professional Advice. All content is for informational purposes only and does not constitute medical, nutritional, physiotherapy or other professional advice.
Personal Use Only. The licence granted is personal, non-transferable and non-commercial.

4. Licence Grant
Subject to your compliance with these Terms, Fit Trainer grants you a limited, revocable, non-exclusive, non-sublicensable licence to (a) install and use the mobile app on your personal device and (b) access the content delivered through the Services—solely for private, non-commercial use.
5. User Obligations & Restrictions
You agree not to:

Remove copyright, trademark or proprietary notices.
Modify, distribute, sell, or exploit any part of the Services (unless a share feature is explicitly provided).
Reverse-engineer or decompile any software provided.
Use the Services for unlawful purposes.
Upload content that is defamatory, obscene, hateful, violent, pornographic, unlawful or that infringes third-party rights.

6. User-Generated Content
If you post or upload any text, images, video or other material (“User Content”) you:

Retain ownership of your User Content.
Grant Fit Trainer a worldwide, royalty-free, irrevocable licence to use, reproduce, adapt and display it for operating and improving the Services.
You warrant that you own the rights to your User Content and that sharing it does not violate any third-party rights.

7. Payments & Subscriptions (if offered)

Pricing & Taxes. Prices are listed in Indian Rupees (INR) and include applicable taxes unless stated otherwise.
Recurring Billing. If you buy a subscription, you authorise automatic renewal until cancelled.
Refunds. Payments are non-refundable after a ten-(10)-day cooling-off period from the first purchase, except where required by law.
Cancellation. You may cancel a subscription at any time in your app-store settings or by emailing the address below; access continues until the current billing cycle ends.

8. Third-Party Links & Content
The Services may link to or integrate third-party content that Fit Trainer does not control. Fit Trainer is not responsible for such content or services.
9. Disclaimer of Warranties
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, FIT TRAINER DISCLAIMS ALL WARRANTIES—EXPRESS, IMPLIED OR STATUTORY—INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. Fit Trainer does not guarantee that the Services will be uninterrupted, error-free or meet your expectations.
10. Limitation of Liability
To the maximum extent permitted by law:

Fit Trainer shall not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, data, goodwill or other intangible losses arising from your use of the Services.
Fit Trainer’s total aggregate liability for any 12-month period will not exceed the greater of (a) ₹5,000 INR or (b) the fees you paid to Fit Trainer in that period.

Some jurisdictions do not allow certain exclusions; the above applies to the greatest extent permitted.
11. Health & Safety Notice
Physical exercise entails inherent risks of injury. Consult a qualified health professional before beginning any new fitness program and stop immediately if you experience pain, dizziness or shortness of breath. You use the Services at your own risk.
12. Indemnity
You agree to indemnify and hold harmless Fit Trainer and the Operator from any claims, damages, liabilities, costs and expenses (including reasonable legal fees) arising from your (a) breach of these Terms, (b) use or misuse of the Services, or (c) violation of any third-party rights.
13. Termination
Fit Trainer may suspend or terminate your access at any time for breach of these Terms or if the Services are discontinued. You may stop using the Services at any time.
14. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of India. Any dispute arising out of or relating to these Terms shall be finally resolved by arbitration under the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be Bengaluru, Karnataka. Proceedings will be in English. Either party may seek interim injunctive relief in the courts of Bengaluru.
15. Changes to These Terms
Fit Trainer may modify these Terms at any time. Updates will be posted in-app or on the website. Continued use after changes take effect constitutes acceptance of the revised Terms.
16. Miscellaneous

Severability. If any provision is held unenforceable, the remaining provisions remain effective.
Entire Agreement. These Terms and the Privacy Policy constitute the entire agreement between you and Fit Trainer.
No Waiver. Failure to enforce a provision is not a waiver of that provision.
Assignment. You may not assign these Terms. Fit Trainer may assign its rights and obligations without restriction.
